About Me

My name is Kurt Padilla. I live in southern New England. I am an employed mechanical engineer and the eldest of three siblings and six cousins (at least on my father’s side). Perhaps these facts make me ideal for retaining as an arbitrator. Perhaps more so, I have an anti-authoritarian streak which makes this sort of arbitration really appeal to me. I’ve also been doing stuff with Bitcoin since relatively early on and I rather enjoyed Heinlein’s /The Moon is a Harsh Mistress/.

Confidentiality and Privacy

I will to the fullest extent possible avoid any disclosure of discussions about on going or past arbitrations. I shall under no circumstances discuss or disclose any information about the case or any party without permission from all parties.

In some cases I will request the permission to post non-personal information about past cases to help establish a case law and reputation in the community*.

*Free arbitration will by default be published. They will not contain personal information nor will they contain what is being bought or sold rather it will discuss the matter in impersonal terms such that reader could understand the general ruling.

Fees

Fees will alway be pre-established and written into the agreement prior to me accepting the agreement. My fees will approximate the following guidelines, but they are negotiable:

• Per transaction: 0.5% of BTC transaction value
• Per dispute: 1.975% of BTC transaction value

Agreements

Parties may retain me without notice, but I make no promises as to my availability unless I am contacted in advance.

I am flexible on the terms of agreements. They must include all terms. I will not consider any terms discussed prior to the publishing of the agreement that are not also included in the agreement (this includes emails, phone calls, messages in bottles, etc).

Agreements must include valid ways to communicate between all parties.

Communication

All communication will be professional. No insults, threats or acts of violence. I reserve the right to rule against any or all parties who act in an unprofessional way during arbitration. If any party fails to respond to communication that is vital for the arbitration process within 14 days, I shall typically rule in favor of the other party.

I prefer to communicate by e-mail (klp at riseup dot net) or Cryptocat. For e-mail communication, please make an effort to employ GnuPG encryption. Everyone should use it for all of their e-mail communications anyway. When e-mailing me, please use both of the following key IDs: F07D99B0 and 42D773F9. I am happy to help newcomers get started with encryption. Just ask.

Dispute Resolution

I will alway listen to both sides of the agreement and will do whatever possible and reasonable to verify any claims made by both parties. I will never involve state (or other) authorities nor will I be party to any agreements that explicitly involve them. I will strive to follow practical and ethical arbitration standards.

In the event of a dispute, I will allow each party to state their case and present evidence. I will actively listen and then double confirm all points. Once both parties are satisfied that I have understood them, I will allow one round of rebuttals. Additional rounds will be permitted on a case by case basis. Subsequently, the parties will rest and I will issue my ruling.
